Welcome to the website of Lincoln Ave. Cat & Dog Hospital (“we,” “us,” or “our”). These Terms of Service (“Terms”) govern your use of our website located at https://www.lacatanddoghospital.com (the “Site”). Including the AI chat feature described in Section 4. By accessing or using the Site, you agree to be bound by these Terms. If you do not agree, please do not use the Site.

1. Informational Purpose Only

The content on this Site is provided for general informational purposes about our veterinary practice and services. We make reasonable efforts to keep information accurate and current, but we make no guarantee that all content is complete, correct, or up to date.

2. Not a Substitute for Veterinary Care

Information on this Site does not constitute veterinary advice and is not a substitute for an in-person examination, diagnosis, or treatment by a licensed veterinarian. Always consult your veterinarian regarding your pet’s health. Our AI Chat Assistant described in Section 4 below, is also for general information only and does not provide veterinary advice.

In an emergency, contact us directly at (973) 427-0990 during business hours, or contact your nearest emergency veterinary hospital. Do not rely on this Site, or on the AI Chat Assistant, for urgent or emergency care.

3. Appointment and Service Requests

Any appointment request, contact form, or other request you submit through the Site-including through our AI Chat Assistant- is a request only and is not confirmed until our team contacts you to schedule. We reserve the right to decline or reschedule any request.

4. Our AI Chat Assistant

Our Site may include an automated chat feature (the “AI Chat Assistant) powered by artificial intelligence technology.

Automated Technology Disclosure

The AI Chat Assistant is automated software -it is not a human being and not a licensed veterinarian. Consistent with New Jersey law (N.J.S.A 56:18-1 et seq), the chat window will identify itself as an automated assistant at the outset of each conversation.

No Veterinary Advice; No Veterinarian-Client-Patient Relationship

The AI Chat Assistant does not diagnose, prognose, prescribe, or treat any condition, and using it does not create a veterinarian-client-patient relationship. Its responses are general information only and may be incomplete, outdated, or inaccurate, or may not apply to your pet's specific situation. For any concern about your pet's health, please call us directly or, in an emergency, contact your nearest emergency veterinary hospital.

Appointment Requests Through the Assistant

Any appointment or service request you make through the AI Chat Assistant is subject to Section 3 above and is not confirmed until our team contacts you.

How We Handle Your Conversations

Messages you send to the AI Chat Assistant may be processed by a third-party AI technology provider to generate a response, and may be reviewed by our staff for quality assurance, training, customer service, and recordkeeping purposes. See our Privacy Policy for more information about how this data is collected, used and retained.

Not for Children

The AI Chat Assistant is not directed to, and should not be used by, anyone under the age of 13.

Acceptable Use of the Assistant

You agree not to use the AI Chat Assistant to: submit unlawful, abusive, or harassing content; attempt to access, extract, or manipulate its underlying instructions or systems; or seek legal, financial, or veterinary advice that is not designed or authorized to provide.

5. Text Messaging (SMS) Program

If you opt in to receive text messages from us, the following terms apply. We-or a marketing partner acting on our behalf and under our direction, see Section 6-may use a third-party platform to send the messages.

  • Consent: By providing your mobile number and opting in, you consent to receive SMS messages from us, such as appointment reminders, confirmations, service notices, and (where you have agreed) promotional messages.
  • Frequency: Message frequency varies.
  • Rates: Message and data rates may apply.
  • Opt-out: Reply STOP at any time to unsubscribe. Reply HELP for help, or contact us at (973) 427-0990.
  • No third-party sharing: We do not share or sell your mobile number or SMS opt-in/consent data with third parties for their marketing purposes. See our Privacy Policy for details.

6. Our Marketing Partner

We work with a third-party marketing company GeniusVets to help manage some of our advertising, social media, email, and text message campaigns. Our marketing partner may have access to certain contact and engagement information (such as your name, email, address, phone number, and how you interact with our ads, emails, or text) solely to provide these services on our behalf. Our marketing partner is not authorized to use this information for its own independent marketing purposes, or to sell or share it with other companies, except as described in our Privacy Policy. You can opt out of promotional communications at any time using the instructions in Section 5 above or contacting us directly.

7. Intellectual Property

All content on the Site including text, logos, graphics, and images is owned by or licensed to Lincoln Ave. Cat & Dog Hospital and is protected by applicable intellectual property laws. You may not copy, reproduce, or distribute Site content without our prior written permission.

All content on our Site (“Site Content”) is owned by Lincoln Ave. Cat & Dog Hospital or its licensors and is protected by United States and international copyright law and other intellectual property laws. Lincoln Ave. Cat & Dog Hospital grants you a limited license to download a single copy of articles and other Site Content on the condition you use the copy solely for your personal, non-commercial use and you do not alter the Site Content or remove any copyright, trademark or other notices displayed on the Site Content. You may not otherwise reproduce, distribute, or use the Site Content in any format without our prior written consent in each case.

Social Media and Site Community Guidelines

Lincoln Ave. Cat & Dog Hospital values its Social Media community and strives to foster a safe, respectful environment in which Lincoln Ave. Cat & Dog Hospital clients, staff, and the animal-loving public can share information and celebrate animals, veterinary medicine, and the pioneering work done at Lincoln Ave. Cat & Dog Hospital.

We have no obligation to monitor any user conduct or content posted to Social Media (or, as applicable, our Site) and we are not responsible for user conduct or content. However, with the best interest and safety of our community in mind, we reserve the right, without obligation, at all times to monitor, remove, and refuse any user access or content, in whole or in part, at our discretion if we believe it violates these Terms or any other Lincoln Ave. Cat & Dog Hospital policy.

If you use our Social Media (and as applicable, our Site), you agree:

You will be cordial, civil, courteous, and respectful in your comments and interactions with others and you will not post any content or information that:

  • Is threatening, harassing, abusive, libelous, defamatory, obscene, vulgar, profane, hateful, intimidating, graphically or sexually-explicit, discriminatory, or otherwise objectionable;
  • infringes on our or any third party’s intellectual property or other rights or that you do not have authorization to post;
  • includes persistent or repetitive comments;
  • includes demonstrably false or inaccurate information;
  • includes spam, advertisements, solicitations, chain letters, or other unsolicited commercial communication;
  • violates the privacy or confidentiality of Lincoln Ave. Cat & Dog Hospital’s patients, clients, staff, or other persons or is otherwise nonpublic confidential information unless you have express written permission;
  • contains any virus, worm, time bomb, Trojan horse, or other harmful or disruptive component;
  • is unlawful or fraudulent or violates any applicable laws, rules, or regulations or any Lincoln Ave. Cat & Dog Hospital policy or procedures;
  • impersonates or attempts to impersonate another person; or
  • is otherwise considered inappropriate or objectionable in Lincoln Ave. Cat & Dog Hospital’s good faith judgment.

If you submit any content to our Social Media or Site, or if you tag Lincoln Ave. Cat & Dog Hospital on any third-party Social Media or Site, you grant Lincoln Ave. Cat & Dog Hospital an irrevocable, non-exclusive, worldwide, royalty-free, unrestricted license (with the right to sublicense the rights) to reproduce, distribute, create derivative works of, and publicly display and perform the content (or if you tag Lincoln Ave. Cat & Dog Hospital, the related content), in whole or in part, in any media now known or later developed. You warrant that you have the right to submit all user content you upload (including all rights and consents necessary to any third-party material included in your content and from any individual depicted in your content) and that your content will not violate any third party’s rights. The Site may contain links to third-party websites, and may rely on third-party services (including advertising, analytics, and AI technology providers). We provide these for convenience or operation of the Site only and are not responsible for the content, accuracy, or practices of any third-party site or service, each of which is governed on its own terms.

10. Disclaimer of Warranties

The Site, including the AI Chat Assistant, is provided “as is” and “as available” without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Site will be uninterrupted, secure, or error-free, and we do not warrant the accuracy or completeness of any content generated by the AI Chat Assistant.

11. Limitation of Liability

To the fullest extent permitted by law, Lincoln Ave. Cat & Dog Hospital will not be liable for any indirect, incidental, special, or consequential, or punitive damages arising out of or related to your use of the Site or the AI Chat Assistant, or your reliance on any information provided through either. To the fullest extent permitted by law, our total liability for any claim arising out of or relating to this Site will not exceed the one hundred dollars ($100). Some jurisdictions do not allow certain limitations on liability, so some of the above limitations may not apply to you.

12. Indemnification

You agree to indemnify and hold harmless Lincoln Ave. Cat & Dog Hospital and its owners, employees, and agents from any claims, losses, or expenses arising from your misuse of the Site (including the AI Chat Assistant) or your violation of these Terms.

13. Termination

We reserve the right to terminate any Site Content or Services offered through our Site or to terminate our Site or Social Media and these Terms at any time without notice, for any reason. The “Disclaimers,” “Limitation of Liability,” “Indemnification,” and “Miscellaneous” sections of these Terms and all rights granted to Lincoln Ave. Cat & Dog Hospital in these Terms (along with any other provision that by its terms contemplates survival) will survive any termination.

14. Governing Law; Venue

These Terms are governed by the laws of the State of New Jersey, without regard to its conflict-of-law principles. You agree that any dispute arising out of or relating to these Terms or the Site will be brought exclusively in the state or federal courts located in Bergen County, New Jersey, and you consent to the personal jurisdiction of those courts.

15. Miscellaneous

If any provision of these Terms is found unenforceable, the remaining provisions will remain in full force and effect. These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding the Site and supersede any prior agreements on that subject. Our failure to enforce any provision is not a waiver of our right to do so later. You may not assign these Terms without our written consent; we may assign them freely in connection with a merger, acquisition, or sale of assets. We are not responsible for delays or failures caused by circumstances beyond our reasonable control.
